Privacy Policy

The following policy sets forth how Warcan Inc. ("Warcan") collects, uses and discloses the information about Warcan users and their authorized representatives ("Registrants") that Warcan collects on this website ("Registrant Information"). This policy applies to www.warcan.com and any web sites related to operation of the Warcan registration services ("Warcan Registration Services"). By using or accessing Warcan's website, you are accepting the practices described in this Privacy Policy.

Information Collected.
During the registration process, Warcan collects identifiable information, including, but not limited to, name, company name, telephone numbers, postal and e-mail addresses relating to the contractor (warranty provider), consultant (if applicable), the client (warranty recepient), and the building, and any other identifiable information that Warcan may reasonably requires in order to provide access to Warcan's applications and services to its Registrants ("Registrant's Inforamtion"). Registrants who use the Warcan Registration Services select or are assigned user names and passwords, all of which are used to identify the Registrants when they are using Warcan Registration Services.

Warcan may also collect names, postal or e-mail addresses, and phone numbers of non-Registrant visitors ("Client Email List"), who have provided their identifiable information to Registrants for, among other things, the purpose of receiving communications from such Registrant, or the purpose of receiving Warcan Registration Services.

Warcan also collects information necessary to facilitate sending and tracking electronic mail outs for its Registrants.

Warcan may retain copies of any communications Warcan sends to or receives from Registrants and other visitors to our site for our records, but may not use any such information except in accordance with the terms hereof.

Warcan's web server collects and saves the default information customarily logged by World-Wide Web server software. Specifically, for each http request received, the date and time, the originating IP address, the object requested, and the completion status of the request is collected and saved.

Warcan analyzes these logs to determine the traffic through the server in hits, the number of pages served, and the level of demand for pages of interest. Warcan may also analyze accesses to particular pages to determine Canadian versus non-Canadian use, government agency versus private use, and other statistics that may be of value to Warcan.

Registrants upload content on the Warcan website(s) at their own risk. Warcan cannot control the actions of Registrants and the information that they provide. Therefore, Warcan cannot and does not guarantee that Registrant's content uploaded on the Warcan's website(s) will be accurate. Registrants acknowledge that, even after removal, copies of Registrant's content may remain viewable in cached and archived pages.

Any improper collection or misuse of information provided on Warcan's website(s) is a violation of the Terms of Service and should be reported on the "contact page"

Use of Collected Information.
Warcan utilizes the information submitted by prospective Registrants to authenticate and verify the identity of such prospective Registrants who may be communicating with Warcan. Warcan will use the information it collects during the registration process, and other information it collects while authenticating the identity of prospective Registrants to evaluate the Registrant's application for use of the Warcan Registration Services and to conduct security and monitoring.

Warcan uses information it collects from Registrants, including but not limited to the Client Email List, in connection the completion of all mailings on behalf of the Registrants. Warcan may use such information to operate, maintain and enhance the Warcan Registration Services and other services offered by Warcan. Warcan also uses Registrant information to monitor compliance with the rules and policies of the Warcan Registration Services.

Warcan compiles and analyzes its Registrants' information into aggregated research reports. Except as may be otherwise agreed in a separate agreement between Warcan and any Registrant, Warcan may share this aggregated data with its business partners.

Registrant access, update or deletion of information collected by Warcan.
Upon written request, Warcan will provide to Registrant a summary of any Registrant Information retained by Warcan regarding the Registrant. Registrants have a responsibility to keep certain information current. Registrants may correct, change or update the Registrant Information and information about their authorized representatives by notifying Warcan in writing of such change. Warcan undertakes to use its best efforts to correct the Registrant Information within a reasonable time after receipt of such request.

Information Sharing.
Warcan and its authorized representatives have access to the Registrant Information, including the Client Email List.  Warcan shares Registrant Information with third parties when Warcan has permission from Registrant or when Warcan believes in good faith that the law requires it or under the circumstances described below.

Warcan may disclose Registrant Information when Warcan has reason to believe that disclosing Registrant Information is necessary to identify, contact or bring legal action against someone who may be violating the terms of use for the Warcan Registration Services or may be causing injury to or interference (either intentionally or unintentionally) with Warcan rights or property, other Warcan Registrants, or anyone else who could be harmed by such activities.

Warcan may share non-identifiable Registrant Information with any third parties. From time to time, Warcan may retain the services of third-party service providers and consultants. Warcan may allow these third parties to access Registrant Information.

Cookies.
Warcan's Web site(s) may use cookies to recognize each Registrant as an authorized user of the Warcan Registration Services, and allow Warcan to provide customized services and improve the performance and usability of Warcan's website(s). Warcan may offer certain features that are only available through the use of a "cookie". Registrant is always free to decline our cookies if its browser permits, although in that case such Registrant may not be able to use certain features on Warcan's website(s).

Registrant choices regarding collection, use and distribution of Registrant Information.
By accepting the terms of the terms of use for the Warcan Registration Services and becoming a Registrant, each Registrant agrees that Warcan may collect certain information (as detailed in this Privacy Policy) from and about the Registrant to authenticate the Registrant and enroll the Registrant as a user of Warcan Registration Services. If a prospective Registrant does not agree to this Privacy Policy, it may not become a Registrant.

Warcan may offer a Registrant during registration or, through a follow-on email, the opportunity to receive offers and information about products and services from Warcan and its partners that Warcan believes may be of interest to the Registrant. The Registrant will be provided a choice whether to accept or not accept this offer.  If Registrant accepts, Warcan (or agents working on behalf of Warcan) may occasionally send the Registrant such information.  If this offer is not accepted, then Registrant will not receive such information.  If Registrant initially accepts, Registrant will be provided opportunity to discontinue receiving such information each time it is sent.

Registrant Contact.
Warcan reserves the right, but is not obligated to contact Registrants regarding account status and changes to the Terms of Use for the Warcan Registration Services, this Privacy Policy, or any other policies or agreements relevant to Registrants.

Security Precautions.
Warcan takes protective measures related to information security within the Warcan Registration Services to ensure the confidentiality of sensitive Registrant Information while stored or in use within the Warcan Registration Services.

This Privacy Policy covers exchanges of information within the Warcan web sites and through Registrant mailings. The Warcan sites may contain links to other sites but Warcan is not responsible for the privacy practices or the content of such sites. Warcan encourages Registrants to be aware when they leave Warcan's website(s) to read the privacy statements of each and every website that collects personally identifiable information. This Privacy Policy applies solely to information collected by Warcan.

Changes to the Privacy Policy.
Warcan may change this Privacy Policy at any time and will post the changes to the Privacy Policy on our website(s). Any change to this Privacy Policy will become effective ten (10) business days after it is initially posted on the Warcan Website(s) unless otherwise agreed with Registrant in writing. Continued use of the Warcan Registration Services following such period will mean that the Registrant accepts such changes, which shall also binds its authorized representatives. If a Registrant does not agree to any such change, it must terminate its agreement with Warcan and cease using Warcan Registration Services.
